6. Withdrawing Redundancy Notice
Withdrawing redundancy notice due to change of circumstances
You have a duty to continue to seek work for an employee served with notice of redundancy right up until the date their employment terminates. Sometimes, there might be a change in your business circumstances such that you are actually in a position to withdraw the redundancy notice, extend the notice or offer the employee their job back. However, this needs their consent.
Consent to withdrawal
Once you’ve issued a notice of termination of employment to an employee, you cannot unilaterally withdraw it, even if there is a change in business circumstances resulting in the redundancy situation no longer existing (this is the same if an employee clearly gives you notice, they cannot retract it without your agreement).
